DAVID C. NUTTER is one of the most versatile mediators in Georgia. He is sought out as an evaluative mediator in civil disputes involving commercial litigation, contracts and torts, employment agreements and restrictive covenants, corporate litigation and dissolutions, real estate, technology implementations, trust and estates, insurance coverage, construction, securities, banking and personal injury suits. David has extensive trial experience, including seven years as an award-winning federal prosecutor in Atlanta, and has had the unusual experience for an attorney of twice being selected to serve on civil juries. He is one of only 14 mediators recognized in Georgia Super Lawyers for Alternative Dispute Resolution in 2008.

In 1983, Mr. Nutter graduated cum laude from Furman University with a B. A. degree. He received a Juris Doctorate, magna cum laude, from the University of Georgia in 1986, where he was admitted to the Order of the Coif and served as Editor-in-Chief of the Georgia Law Review from 1985 to 1986.

In 1986, Mr. Nutter served as a law clerk for the Honorable Patrick E. Higginbotham, U.S. Court of Appeals, Fifth Circuit. He was admitted to the Georgia Bar in 1987, and was an associate at King & Spalding from 1987 through 1991 where he handled civil litigation matters, including class action defense, lender liability, banking litigation, insurance coverage disputes, employment litigation, computer licensing disputes, securities litigation, trusts and estates litigation, corporate litigation and corporate dissolutions.

From 1991 through 1998, he was employed as an Assistant United States Attorney where he prosecuted fraud and public corruption cases, including numerous bank fraud, credit card fraud, check fraud, consumer fraud and tax fraud cases. During his tenure as an Assistant United States Attorney, he received the Department of Justice’s Director’s Award for Superior Service as an Assistant United States Attorney (1996) and the Federal Bar Association’s National Younger Federal Lawyer Award for outstanding service to the U.S. Government (1995).

From 1998 until 2005, Mr. Nutter was a partner at the law firm of Nations, Toman, Nutter & McKnight LLP representing plaintiffs and defendants in banking litigation, consumer class actions, professional liability matters, securities litigation, employment litigation, restrictive covenant litigation, construction litigation, trusts and estates disputes, franchise disputes, real estates disputes, corporate litigation and corporate dissolutions.

Mr. Nutter is an AV rated attorney and is a member of the State Bar of Georgia, The Lawyer’s Club of Atlanta, and The Atlanta Bar Association. He is presently Vice-Chairman of the Fulton County Board of Ethics. Mr. Nutter and his wife Susan have five children.
